These Terms of Service ("Terms") govern your access to and use of the a-payment.pro website (the "Site") and any services, platforms, interfaces, or technologies operated or made available by or on behalf of the operator of this Site ("a-payment", "we", "our", or "us"). These Terms form a legally binding framework for all users, including business entities, corporate users, and authorized representatives (collectively, "Users", "you", or "your").

By accessing or utilizing the Site or any part of our services, you confirm that you understand and accept these Terms. If you do not accept the Terms in their entirety, you are not permitted to use the Site or services.

1. Purpose and Scope

1.1. a-payment.pro is a digital technology platform that provides payment infrastructure, transaction routing, and integration tools to commercial clients for processing online payments.

1.2. These Terms apply to all interactions with the Site and all services provided therein, regardless of whether you are a registered account holder or an unauthenticated visitor.

1.3. The Site and services are directed solely at legal entities and professionals acting in the course of business.

2. User Eligibility and Onboarding

2.1. To access the services, Users must:

  • be legally incorporated entities or registered self-employed individuals;
  • have full capacity to enter into binding agreements;
  • not be subject to any applicable sanctions or trade restrictions;
  • not be located in a jurisdiction listed on a restricted countries list, as maintained by a-payment from time to time.

2.2. Users acting on behalf of entities represent that they are duly authorized to bind their organization to these Terms.

2.3. a-payment reserves the right to refuse service, revoke access, or require re-verification at any time, with or without reason.

3. Account Management and Security

3.1. Access to services may require creation of a client account. Users must provide accurate, current, and complete information.

3.2. Users are solely responsible for safeguarding their authentication credentials and ensuring that only authorized personnel access their account.

3.3. You agree to notify a-payment without undue delay of any breach of account security or unauthorized access.

4. Data Handling and Privacy

4.1. We process both personal and business-related data in full compliance with Regulation (EU) 2016/679 (General Data Protection Regulation), Directive 2002/58/EC (ePrivacy Directive), and any other applicable EU or national data protection legislation.

4.2. a-payment collects, processes, stores, and transfers data for legitimate business purposes including account registration, identity verification, regulatory compliance, service customization, and fraud prevention.

4.3. By using the Site and services, you consent to the data practices described in our Privacy Policy. The Privacy Policy describes in detail:

  • the categories of personal and business data collected,
  • the lawful bases for processing (including contractual necessity, legal obligations, and legitimate interest),
  • your rights under data protection laws (such as access, rectification, restriction, portability, and erasure),
  • security measures in place to safeguard data,
  • data retention periods,
  • the possibility of data transfers outside the European Economic Area (EEA) subject to appropriate safeguards.

4.4. Our use of cookies, trackers, and other similar technologies is also addressed in the Privacy Policy. By continuing to use our Site, you consent to such usage.

5. Use of the Platform

5.1. Users may not:

  • engage in unlawful or fraudulent activity;
  • interfere with or disrupt system integrity;
  • reverse engineer or tamper with platform components;
  • use the services to process transactions on behalf of any third party not subject to prior onboarding and due diligence.

5.2. a-payment reserves the right to investigate and block any activity it deems suspicious, unauthorized, or non-compliant with legal obligations.

6. Financial Terms and Refund Conditions

6.1. Fees and pricing for services are either contractually agreed upon or published on the Site. Prices may be updated unilaterally.

6.2. Users must ensure prompt payment of any applicable charges, inclusive of all applicable taxes, unless expressly exempt.

6.3. Refunds will be processed only when:

  • required under applicable consumer protection or electronic money laws;
  • due to validated duplicate charges or technical system errors;
  • otherwise agreed in writing by a-payment in the course of a support or reconciliation process.

6.4. All refund requests must be submitted by the authorized account holder, supported by transaction records and justification.

6.5. Approved refunds will be issued to the original payment method. Refunds are generally processed within thirty (30) business days, unless extended due to AML/CTF verification or other regulatory review.

6.6. a-payment shall not issue refunds:

  • in cases of fraudulent chargebacks;
  • if related to third-party services;
  • where a violation of these Terms or the law has occurred.

7. AML and Risk Controls

7.1. a-payment maintains a comprehensive Anti-Money Laundering (AML) and Counter-Terrorist Financing (CTF) compliance framework.

7.2. Use of our platform is conditional upon full cooperation with our AML obligations, including submission of KYC data, identification of beneficial owners, and confirmation of business activity.

7.3. We may restrict or terminate services where:

  • incomplete or inaccurate data is provided;
  • transactions suggest illicit or non-transparent behavior;
  • the User or counterparties are listed on international sanctions registers.

7.4. Further provisions on our internal risk management, sanctions screening, transaction monitoring, and audit practices are described in the AML and Security Policy.

8. Availability and Maintenance

8.1. a-payment provides its services on an "as available" basis and makes no warranty regarding uptime, response time, or uninterrupted availability.

8.2. Maintenance windows, downtime events, and force majeure situations may result in temporary disruption of service.

9. Legal Compliance and Governing Jurisdiction

9.1. These Terms and your use of the Site and services shall be governed by the laws of the European Union and the jurisdiction of the Member State in which a-payment is lawfully established.

9.2. Disputes shall be submitted to the competent court of that Member State, unless otherwise agreed in writing.

9.3. a-payment reserves the right to comply with requests from financial regulators, data protection authorities, or courts.

10. Liability and Limitation

10.1. To the maximum extent permitted by law, a-payment disclaims all liability for:

  • indirect or consequential loss;
  • loss of business, data, profits, or revenue;
  • any claim based on platform unavailability or external service failures.

10.2. Total liability for all claims in any twelve-month period shall not exceed the fees paid by the User for the specific services giving rise to the claim.

11. Intellectual Property

11.1. All platform elements (including but not limited to code, design, content, names, marks) remain the intellectual property of a-payment or its licensors.

11.2. No license is granted except as strictly necessary to use the platform as intended and described in these Terms.

12. Amendments and Language

12.1. These Terms may be modified from time to time. Changes become effective upon publication to the Site.

12.2. Continued use after such changes constitutes acceptance.

12.3. These Terms are published in English. Translations are for convenience only; in case of conflict, the English version shall prevail.
